Dear Mr Clark and Lord Tim Clement Jones,

We've sent the BIS/Department of Business, Energy and Industrial Strategy
611 "urgent nudge emails" after they asked us to be, "more specific" about
our complaint about the RICS and its "appointed" company OS:Property.
We've heard nothing so far.

Q. Mr Clark, isn't the plight of the countless, nameless victims of the Ombudsman Services:Property Ombudsman's illogical decisions worth a reply or are you looking into the matter?

The victims of its ombudsman's illogical decisions are all but forgotten.
Some got 50 quid last year for their troubles. In 2009 some got
£1.511.769.
An example of the ombudsman shaving money of awards no doubt because of "urgent nudge emails" from persons unknown.

Q. Lord Tim Clement Jones, when unnamed individuals express some concern over the level of awards and the ombudsman takes a hatchet to them, isn't this direct interference in the impartiality of the ombudsman?

The Corporation of London rightly purchased apartments for some of the
victims of Grenfell whose council shaved £300.000 of the cost of the block's
refurbishment when they already had £300M in reserve.
Q. Why isn't the Corp[oration of London compulsorily purchasing more empty apartments bought by foreign speculators at the original price plus say .25% interest for the speculators' troubles?

Wouldn't this be a timely example of Theresa May stepping up, challenging vested interests and righting an unforgettable wrong done to those who ain't got no home in this world anymore?

(How The Establishment uses time and a refusal to answer questions to such devastating effect.)

Dear Mr Clark and Lord Tim Clement Jones.

Nicholas Paget-Brown, so-called leader of Kensington and Chelsea council, had clearly consulted The Manual On How To Duck And Dive, before reading his short statement and then leading his cabinet members in hasty retreat as they collectively ducked and dived for cover leaving everyone else but them to shoulder responsibility and take the blame.

It how things are done in today's Conservative Party. It's how things were done in yesterday's Conservative Party too. It's one thing guaranteed not to change - the cover-up.

There was to be no fight on the beaches, on the landing grounds, in the fields and in the streets or in the hills even - they simply scarpered.

Why should anyone be surprised? 

It's what the Establishment does when it cocks-up. It makes a short statement which merely adds insult to injury and then clams up and waits for time and a painfully slow justice system to slowly grind into action - or not as is the case with the Orgreave miners.There, time and silence and Amber Rudd, are still keeping the truth well and truly hidden down some deep, dark pit.

As for the victims of Ombudsman Services:Property's illogical Final Decisions, imposed Mutually Acceptable Settlements and occasional 50 quid hand out - who, apart from us, is speaking up for them? They have been consumed by the silence.

Gillian Fleming, the then Ombudsman Services:Property Ombudsman stated,
"We will always need to ensure the resolution we offer is the right one but during a strained economic climate our outcomes are looked at more closely. The stakes are not only high for the consumer - because their home is important to them - but our decisions have important ramifications for property professionals. It can be of great consequence for them to pay out to a complainant, especially as the maximum award is £25.000."

This is an extraordinary statement by a supposedly "independent" ombudsman.

Q. Lord Tim Clement Jones, why the,"but" which implies that the ombudsman, truth be known, won't always ensure the resolution she offers is right because of the strained economic climate?

Q. Lord Tim Clement Jones, it seems that although the "stakes are high" for the consumer - they're even higher for your members. Is this why your company reduced average so-called "financial awards" from £1.511.76p in 2009 to just 50 quid in 2016?

Q. Lord Tim Clement Jones, we're told by the ombudsman that, "it can be of great consequence for them to pay out to a complainant" is this why so very few complainants actually get the 50 quid?

Q. Lord Tim Clement Jones, who is looking at your outcomes "more closely?"

    Q. Lord Tim Clement Jones, whoever it was who was looking at your outcomes more closely certainly        got the, "financial awards" spectacularly reduced. Let's face it, is it not true that your ombudsman              simply does the bidding of those looking at her outcomes more closely?

Q. Lord Tim Clement Jones, do you still assure the complainant that your ombudsman is, "entirely independent?"

Q. Lord Tim Clement Jones, we're being told by this Tory government that the British economy has never been stronger. It that is indeed the case, and the economic climate is no longer strained, why are some property complainants still only getting 50 quid?

Q. Mr Clark, are you able to assure property complainants who use this private redress scheme to find private redress and civil justice, that their complaints will be forensically examined by an ombudsman who is both, "fair" and, "independent?"

610) From "RICS" to "RIGS."

Dear Mr Clark and Lord Tim Clement Jones,

The Royal Institute of Chartered Surveyors - RICS - would have us believe that they,
"regulate and promote the profession, maintain the highest educational and
professional standards, protect clients and consumers via a strict code of ethics and promote impartial advice and guidance."

The then Head of Regulation at the RICS, Eve Salomon, when asked to present to the Leveson Inquiry about self-regulation said,
"So, the first message this regulating anorak has to the inquiry is that self regulation, when it works, is far preferable to statutory regulation. Why? Because by its nature it suggests a willingness to comply rather than the begrudging obligation that so often comes with statutory obligation."

When it works? Eve Salomon when would that be? Not when our surveyor packed us off to his ombudsman and not when Lloyds packed their clients off to Alder King.

Q. Mr Clark, Lord Tim Clement Jones, is there not a conflict of interest when RICS "regulated" surveyors send their dissatisfied clients to their ombudsman scheme which is funded by their fees and their ombudsman, in strict adherence to RICS' Memorandum of Understanding on the effective resolution of disputes, hands those clients an illogical Final Decision and sometimes, though not very often, 50 quid?

Chillingly, Eve Salomon went on to warn the Leveson Inquiry that if the billionaire owners of the free press weren't left to do as they please when they please,
"We would end up watching a battle between the armies of the press and the unarmed regulator, the regulator will be slaughtered."

So much for living in a modern civilised western democracy.

She went on,
"...don't impose a new regulatory arrangement...If you do, I for one will be standing well back when the onslaught hits. I don't like the sight of blood."

Hence, the self regulating Daily Mail's depiction of the three judges as being, "Enemies of the People." They of course meant, "Enemies of the Billionaires."

Hence, the triumph of self - regulating private civil justice as it colonises all before it.

According to Jo Stevens, Labour MP Cardiff Central,
"No self-regulator will ever say otherwise, but the question is whether RICS is delivering on that commitment in practice. Unfortunately, in the experience
of my constituent, Mr Shabir. and many others, the answer is emphatically no."

Q. Lord Tim Clement Jones, RICS are emphatically not acting to protect consumers' interests and is this not reflected in their micro management of disputes at their appointed company - Ombudsman Services:Property - where they monitor your performance regarding the effective resolution of disputes?

Q. Lord Tim Clement Jones, why do you no longer ask consumers whether they consider a 50 quid financial award, an effective resolution of their dispute?

Q. Lord Tim Clement Jones, how can the RICS be fulfilling its duty to act in the public interest when it doesn't bother to consult the public on whether it has acted in their interest or not?

The regulators at RICS/RIGS - a byzantine, empire building juggernaut of an organisation - have long since forgotten that it's function is to serve the public interest not that of those who like to act behind the scenes.

Adrian Bailey, West Bromwich Labour, speaking on the same subject stated,
"The wide consensus of opinion about the awfulness of the actions and the terribleness of the experience that the individuals have gone through - let us be clear, it is reflected by many other small businessmen and women up and down the country - raises matters of huge concern."

Q. Mr Clark, is it part of the Tory Party Industrial Strategy to allow RICS to fleece small business men and women and consumer property complainants on an industrial scale and how is that benefitting the public?

Dear Mr Clark and Lord Tim Clement Jones,
In his article George Turner believes that, "professionals have appeared to abuse their professional roles." That, " It is obvious that if a surveyor manipulates their valuations in order to allow their client take value away from the community, then it is not in the public interest."
In return for the Royal Charter RICS - or more accurately RIGS - are expected to act in the public interest. But whose checking? No-one apart from George Turner and the Ombudsmans61percent Campaign, or so it would seem.

Q. Lord Tim Clement Jones, when RICS/RIGS monitor you for the effective outcome of disputes are they acting in the public interest or that of their own?

George Turner asks, "So where have RICS been on this issue? the simple answer is nowhere. and at the recent GLA Planning Committee Hearing two senior members of RICS argued against deals being made public."

This is how RICS/RIGS  would appear to operate; behind closed doors, behind the scenes and down the dark corridors of power. This is how "political influencing" and "engagement work" operates - without transparency and without accountability.

Q. Mr Clark, how is any of this in the public interest?

And so this is how rigged market capitalism gets rigged.

In, Margrethe Vestager, has an European commissions competition commissioner with teeth.
Someone prepared to take tough decisions. To stand up, challenge vested interests and right wrongs.
Unlike here.
Here politicians like Vince Cable get to told by the regulator RICS to "fix"
the lettings market and do as they're told. Here politicians don't tell RICS to "fix" its dysfunctional market in surveying.

Q. Lord Tim Clement Jones, the OFT has said that the surveying market is dysfunctional, why as the Chair of a private redress scheme, aren't you marshalling your best efforts to challenge this blatant injustice?
In Europe the commissioner alleged that Google systematically favoured its own comparison shopping product. Here, RICS favours letting its surveyors send their dissatisfied clients to their appointed ombudsman.

In Europe a billion Euro fine was handed out.
Here, the surveyors' ombudsman reduced awards from £1.51.76p in 2009 to 50 quid in 2016.
Here, Ombudsman Services are - through the agencies of RICS and their behind the scenes engagement and political influencing work - looking to create a monopoly in private redress and so-called "civil justice."

Q. Mr Clark, were Ombudsman Services to monoplise the private market in redress would that be in the consumer's interests?

608) Sajid Javid: "Grenfell has shaken my comprehension of being in office."

Dear Mr Clark and Lord Tim Clement Jones,

Sajid Javid has recently said, "Grenfell has shaken my comprehension of being in office.

He clearly needed to have gotten out of his office more often, associated with the victims of appallingly regulated markets and seen at first hand what de-regulated markets and light-touch regulation actually meant for their victims.

It seems to have taken Sajid Javid an awful long time to have arrived at his new comprehension and one can only speculate as to what he was comprehending previously. 

Not any of our 81 recorded emails to him when he was BIS Secretary from 2015-16, that's for sure.

Emails which attempted to bring to his comprehension the abject failure of the RICS to adequately regulate their Members and  (Un)Regulated Firms which allowed poorly regulated surveyors to, "develop practices that do not work in the customer's interests." (OFT) 

He insists that, "as a minister I have always been prepared to make tough decisions" which is all very well and fine. However, being prepared to make tough decisions is one thing - actually taking them, actually carrying them out, is of a different magnitude altogether.

When it came to challenging the RICS over its micro-management of OS:Property to ensure, "the effective resolution of disputes" Sajid Javid appears to have bottled out, it being one tough decision too-far.

Q. Lord Tim Clement Jones, why do the RICS closely monitor OS:Property for the way it, "effectively resolves complaints" when it can't adequately regulate its Members and (Un)Regulated Firms in the first place?

Q. Mr Clark, as someone whose department has a close and continuing relationship with Ombudsman Services, do assure consumers that when they take their complaints to OS:Property each and every one of them will be meticulously investigated by a fair and independent ombudsman?

Dear Mr Clark, Lord Tim Clement Jones and Mr Hunt,

Imagine - Conservative politicians, whose salaries are paid for by the British taxpayer, responding promptly to the BBC's requests for interviews at a time of national emergency. In total contrast, well done Plymouth's Luke Pollard MP (Sutton and Devonport abd Labour) and for offering worried residents a brilliant solution to the immediate problem.

Imagine - an ombudsman scheme that is transparent, accountable fair and totally independent.

Imagine - a world in which there is no need for Livewell Southwest's Anonymous Desk Top Reviewers because the inhumane, barbaric extortion racket that is The National Framework for NHS Continuing Health Care and NHS Funded Nursing Care, has been consigned to the waste-bin of history.

Imagine - Ombudsmen who act independently, fearlessly and with unimpeachable integrity.

Imagine - Healthcare Professsionals who act with their patients' interests in mind and not those of a newly privatised profit making shadowy consortium.

DJS Research - who were truly independent and professional with their Customer Satisfaction Reports - stated,
"8.24: to be effective the SOS (now rebranded as Ombudsman Services:Property) must be seen as an impartial arbitrator between parties - currently this does not seem to be the consensus of opinion."

In other words most consumers thought that the Property Ombudsman was biased.

We tried asking the Ombudsman, Gillian Flemming, The Chair, Professor Dame Janet Finch and the CEO and Chief Ombudsman, The Rev Lewis Shand Smith the following question:
Q4. How do you account for the arbitrator's lack of impartiality? If the arbitrators are not impartial are they not open to the charge of bias?

No-one was available to give us an answer.

Q4. Lord Tim Clement Jones, consumers haven't a clue as to what the consesus of opinion is regarding the ombudsman's impartiality when settling disputes because the company that replaced DJS Research no longer asks them. Why don't they ask them such a straightforward question?
Q4 cont. Is it because you know what the answer would be and so avoid asking the question so as to maintain the myth that the Property Ombudsman is impartial?

Livewell Southwest Ltd do not publish data on the number of Desk Top Reviews made by the Anonymous Desk Top Reviewer that find against the sick, the elderly and the dying. Nor do they say how many Plymothians are phoned at home by anonymous professional healthcare workers telling them that their sick, elderly and dying relatives are not entitlked to a full DST Assessment when the truth of the matter is that they are.

Q. Mr Hunt, why is this barbaric, degrading and inhumane practice allowed to continue in a modern 21st century democracy?

The maladministrators at Ombudsman Services had the gall to advise government on the EU Directive on ADR.

Q. Mr Clark, as someone whose department has a close and continuing relationship with the maladministrators at Ombudsman Services, when you eventually emerge from your bunker are you able to assure consumers that when they take their complaint to Ombudsman Services that each and every one of them will be forensically investigated by a highly competent and impartial investigator? 

You may say I'm a dreamer but thanks to Jeremy Corbyn, I'm not the only one.

606) Someone Has Just "Upped Their Game" And Our Facebook Account Has Now Been Censored.

Dear Mr Clark and Lord Tim Clement Jones,

Such a pity that the censorious, anti-democratic dirt-bag responsible for closing our Facebook account didn't have the intestinal fortitude or common decency to say just exactly why they objected to it or leave their name so we could get back to them. 

So we must be doing something right.

Mr Clark, Lord Tim Clement Jones don't you agree - there's so much political influencing and engagement work that goes on behind the scenes these days. 

It was once called lobbying until The RICS got hold of it and got Vince Cable to, "fix" the lettings market.

Here, at the Ombudsmans61percent Campaign we were delighted to come across the following article on the Liberal Democratcs and their less-than-liberal approach to Political Influencing and Engagement Work - lobbying;
             "Some of the Lib Dem connections are transparent, others are less so.
              Nick Clegg's wife is a lawyer at DLA Piper which is effectively a lobbyist
              - DLA as a global law firm advises hundreds of clients on inter-Government 
              relations, from the Ethiopian regime to private healthcare interests She is 
              joined by such prominent Lib Dems as Lord Tim Clement Jones, a
              managing partner at DLA Piper who was responsible for marshalling
              support in the Lords for the NHS bill (the lack of rules in the Lords on 
              conflicts of interests meant he was able to do as he pleased) Oh, and
              DLA Piper has for years refused to sign up to a lobbying transparency
              register."

So, the RICS, who can' or won't regulate their own Members and (Un)Regulated Firms, get the Lib Democrat Business Secretary, Vince Cable to "fix" the cowboy operators in the lettings sector but not the cowboy operators in the surveying sector who they can't or won't regulate. They then get the Lib Democrat, Jo Swinson to amend legislation in Parliament but when we try contacting her she simply ignores us. Whilst this is all going on the RICS are telling their appointed ombudsman at their appointed company, Ombudsman Services:Property, what is and isn't an effective resolution of a dispute. We try contacting the company about their appalling lack of transparency and accountability but they simply ignore us as well.


And then you, Lord Tim Clement Jones, turn up as the new Chair.

Q. Lord Tim Clement Jones, how - as someone who apparently did as he pleased in the Lords on the NHS bill and as managing partner of DLA Piper which has for years refused to sign up to a lobbying transparency register - do you meet Ombudsman Services' requirement to be a person of unimpeachable integrity?

 The article continues;
              "None of this is unusual of course - it is merely in keeping with the
               ways of the political establishment Clegg once claimed he would tear
               down. Nick promised us deep changes if the Liberal Democrats
               entered Government ... instead we got Comrade Napoleon's Animal
               Farm."

Oh dear - lack of rules, conflicts of interests, lack of transparency, The Establishment doing as it pleases, saying one thing yet doing another - what fools we common folk be to believe a word of what you say.

Q. Mr Clark, as someone whose department has a close and continuing relationship with the maladministrators at Ombudsman Services, are you able to assure consumers that when they take their complaints to this private redress scheme, each one will receive a fair, transparent, independent and forensic investigation by a competent individual?

Dear Mr Clark and Lord Tim Clement Jones,

For foolish mortals, it will be yet another midsummer day's nightmare for those unfortunate enough to have property complaints and who misguidedly take them to Ombudsman Service:Property in the forlorn expectation that they will be fairly and independently investigated.

Q. Lord Tim Clement Jones, is The Rev Shand Smith still boss of Property, as The Warrington Guardian article implied that the great man wasn't.

Q. Lord Tim Clement Jones, if The Rev Shand Smith isn't boss of Property at Ombudsman Services, who is?

Q. Lord Tim Clement Jones, is it not the case - as The Ombudsmans61percent Campaign has always maintained - that The RICS boss the show at Ombudsman Services:Property and tell The Rev Shand Smith what and what not to do?

DJS Research's Customer Satisfaction Report at (8.24) implied as much when stating;
"to be effective the SOS (now rebranded as Ombudsman Services:Property) must be seen as an impartial arbitrator between parties - currently this does not seem to be the consensus of opinion."  

Ombudsman Services:Property is not an effective or impartial arbitrator between property complainants and surveyors.

Question 3:
Q. Lord Tim Clement Jones, how do you explain this lack of, "effectiveness?"

This is an extraordinary situation for a supposedly, "fair" and "independent" private redress scheme to find itself in - especially one with a Memorandum of Understanding with the RICS who monitor it for what they determine to be, "the effective resolution of disputes."

The Rev Shand Smith has described this as being a, "superb model."

Q3 cont. Lord Tim Clement Jones, is finding in favour of RICS Members, "effective" and is this what The Rev Shand Smith means when he describes this as being an example of, "a superb model?"

This would imply that those RICS monitors who check the independent ombudsman for, "effectiveness" are more than satisfied with this lack of impartiality.

Otherwise things would be different.

Q3 cont. Lord Tim Clement Jones, where does the foolish, mortal, complainant stand in all this, if not at the back of the queue? 

Q3 cont. Lord Tim Clement Jones, isn't it time you upped your game, stopped blaming consumers for what Private Eye would describe as your, "piss-poor performance" and sort this shambles out?

A Liberal Lord who blames complainants for complaining and a boss who believes a lack of impartiality is evidence of a superb model civil justice and redress - it's Shakespearian.

Mortals being made fools of by those who boss them.

Q. Mr Clark, as someone whose department has a close and continuing relationship with Ombudsman Services, are you able to assure consumers that when they take their complaints to this private redress scheme they will each receive an impartial, effective, fair and totally independent investigation of their complaint?

Recommendation - there be a public enquiry into the RICS "appointed" Ombudsman Services:Property and the role of RICS' monitors in the, "effective resolution of disputes."

604) Recommendations For A More Transparent, Accountable And Just Ombudsman Services And Livewell Southwest Ltd.

Dear Mr Clark, Lord Tim Clement Jones, Mr Hunt and Professor Steven Waite,

The present systems are rigged, dysfunctional and not fit for purpose. 

They need to be brought into line with a modern 21st century post-Brexit Britain where democracy ensures that people such as yourselves who make decisions such as you are totally accountable for those decisions and that the systems you operate are also totally transparent.

Recommendations:
1. The RICS cease all involvement with Ombudsman Services and start to
    effectively regulate their Members and (Un)Regulated Firms.

2. That DJS Research-like Customer Satisfaction Reports be immediately
    re-instated at Ombudsman Services.

3. That the practice of having professional healthcare workers who are
    anonymous to their patients end immediately.

4. That the inhumane, degrading and rigged so-called DST Assessments
    end immediately.

5. Victims of fraudulent DST "Assessments" and illogical Final Decisions be
    compensated.

6. Those sick, elderly and dying victims of the DST Extortion Racket who were
    forced to employ solicitors and advocates to re-coup what was extorted
    from them be reimbursed in full for the costs they were forced to incur.

7. Those responsible for conducting such so-called assessments be
    prosecuted.

8. All decisions are put into a database and freely available for public scrutiny
    on the internet.

9. Each person responsible for making the decision be named. 

10. All such decisions enshrine the right of the recipient - complainant or 
     patient - to say whether they are: very satisfied, satisfied, dissatisfied or very
     dissatisfied with the decision.

11. All appeals should be heard within a strict time frame with delays incurring
      fines.

The existing National Framework for NHS continuing healthcare and NHS funded nursing care is a barbaric, inhumane and degrading disgrace and should be consigned to history along with the so-called speedy, fair and independent investigations of property complaints at Ombudsman Services:Property.

Both show remarkable similarities.

Dear Mr Clark and Lord Tim Clement Jones,

The evidence - a precious commodity in this day and age - can either be embraced, respected and acted upon or shunned, disrespected and surreptitiously binned.

To suggest that 43% of property complainants are the beneficiaries of a, "superb model" and this company's, "best efforts" takes us on a journey down the latter road.

The Rev Shand Smith, having looked at the evidence comes to the remarkable conclusion that,
"we have a superb model that provides high quality outcomes to consumer complaints."
He would appear to inhabit a land of mythical kings and iguanas.

Sure that everything of worth is in the sky and not on earth.

Q 2. Lord Tim Clement Jones, how do you account for the fact that complainant after complainant failed in their complaint, the Independent Assessor only had to make one small award against the Ombudsman?

It seems everyone at Ombudsman Services is fitted with rubber teeth.

Q. Mr Clark, as someone with a close and continuing relationship with this private redress scheme, are you able to assure complainants that their complaints with be "investigated" both, "fairly" and, "independently?"
