The ombudsman system is rigged - or has been captured by the businesses ombudsmen are supposed to ombuds. The RICS provided a blueprint. They "appointed" OS:Property who appointed an "illogical" ombudsman. She found in favour of her fee-paying RICS Members. Thus saving them £ks. The Rev Lewis Shand Smith CEO/Chief Ombudsman at Ombudsman Services called The RICS "scheme" - "a superb model of ADR." Until it collided with reality and disappeared. There is no trace of it ever having existed. No Minutes, Annual Reports or statements by Independent Assessors. We did ask our then MP, Oliver Colvile, to raise the issue of the "illogical" OS:P ombudsman with Grant Shapps and also her interpretation of the company's Terms of Reference. Shapps replied saying he wasn't able to open a concluded investigation. Something we did NOT ask for. Creutzfeldt + Gill offer a good appraisal of what happened and why there are "Ombuds Watchers." What really needs explaining they say, is an explanation as to why ombudsman "investigations" are all but worthless. Why was Gillian Fleming according to DJS Research "illogical?" We tried raising the issue of the illogical Ombudsman Services:Property ombudsman with Jonathan May Executive Director of the OFT but although he recommended the scheme to the British taxpayer we were told he had the most minimal involvement with its Terms of Reference. The OFT's civil servants who "monitored" the Jonathan May approved scheme saw nothing wrong with Ombudsman Services not publishing an Annual Property Report for 2 years although as a stipulation for approval such a report was deemed necessary. Transparency and accountability? The OFT also declined to answer any of our questions concerning the maladministration of consumers' complaints by Ombudsman Services. Were were told it could not be justified on the grounds of time and cost. So no transparency or accountability there. We also approached Dame Helena Kennedy's committee and asked if we could respond to The Rev Lewis Shand Smith's presentation on the implications of EU legislation post Brexit. We're still waiting. Oliver Colvile did send our complaint about the way the OFT had - or more accurately hadn't - handled our complaint about The Rev Lewis Shand Smith's superb model of ADR to the PHSO. After asking us for more information Dame Julie Mellor then threatened us with prosecution. We also asked Martin Lewis to invite us on to his ITV show to discuss his whitewash report for Yvonne Fovarue's APPG: Sharper Teeth - The Consumer Need For Ombudsman Reform. Still waiting although Yvonne did remove it from her webpage. Which is a start. Julia Hearnden wrote: "We chuckle when we read the reply from our surveyor to our complaint - refer to the Surveyors Ombudsman!! That was a no risk strategy for them! It has been eye-wateringly ludicrous! We have suffered financial loss and severe health issues. I really do want to tell my story if for nothing more than to help other people."
