412) Great Myths of The Early 21st Century - The Independence of The Ombudsman.

The Ombudsman Services' literature tells the consumer that the ombudsman is "entirely independent." We don't believe that this is entirely true.

For instance, the ombudsman has to comply with The RICS Memorandum of Understanding which states - ominously;
"RICS and OS:P will work together....to foster the effective resolution of disputes."

If the ombudsman is, "working together" with The RICS then they're not entirely independent - because they're, "working together" with The RICS. If you work together with someone how can you possibly be entirely independent? You can't. Then there's the small matter of The RICS also paying the ombudsman's salary.

How many bite the hand that feeds them?

And what if the ombudsman fundamentally disagree with The RICS as to what is and isn't, "the effective resolution of disputes?"
Let's face it there's only ever going to be one winner here and it isn't going to be the ombudsman.

We asked the Chair of Maladministration at Ombudsman Services;
Q. 92: Does the presence of the Director of Professional Regulation for RICS, being a Board Member, in any influence the ombudsman in these matters?

The Chair of Maladministration didn't reply.

Q. Mr Javid, Business Secretary, when RICS Members' and (Un)Regulated Firms' fees pay for the salary of their ombudsman, there is a Memorandum of Understanding stating what is and isn't an effective resolution of disputes and The RICS Director of Professional Regulation sits on the Board, isn't it stretching the bounds of credibility to claim that the ombudsman is, "entirely independent?"

411) Question 92 to the Chair of Maladministration at Ombudsman Services.

According to the late Consumer Focus, The Royal Institute of Chartered Surveyors (The RICS) has developed practices that do not work in the customer's interests and that this is largely due to a failure on their part to adequately regulate their Members or (Un)Regulated Firms.

If The RICS - Royal Charter and all - was doing the job it was set up to do and actually regulated the cowboys who trade under its name, we (and countless others) probably wouldn't be where we are today. Unfortunately, as a result of this inexcusable RICS regulatory failure their rogue traders have accumulated record numbers of dissatisfied customers.

So how did The RICS respond to this regulatory failure? Did they;
a) Belatedly begin to adequately regulate their Members and (Un)Regulated Firms.
or
b) Get their Members and (Un)Regulated Firms to send their dissatisfied clients to The RICS "appointed" Ombudsman Services:Property which is financed by RICS Members' and (Un)Regulated Firms' fees where there is an expectation that those maladministering the scheme on their behalf will spend their money wisely.

Yes, it was (b). We believe it's a scheme designed to save RICS surveyors lots of money.

The number of RICS clients being rounded up and herded off  to The RICS "appointed" ombudsman at The RICS "appointed" Ombudsman Service:Property increases every year. A cataclysmic failure of RICS regulation that has the effect of saving the surveying "sector" millions £££s annually. For RICS Members the savings on expensive insurance claims must be enormous. It's far more cost effective for them to hand their troublesome clients to their "appointed" company and leave them to maladminister the complaints.

It's the client who is on the receiving end of the maladministration - not the fee-paying Member.

This RICS regulatory failure has become a matter of routine - custom and practice - and has resulted in a regular cull of their clients by those criminally maladministrating the scheme. Apparently. Otherwise it would be different.

Dear Mr Javid, Business Secretary,
We asked the Chair of maladministration at Ombudsman Services;
Q. 92: Does the presence of the Director of Professional Regulation for The RICS, being a Board Member, in any way influence the ombudsman in these matters?

Matters such as: not understanding the nature or complexity of property complaints, arriving at decisions in an illogical manner, denying consumers their Human Right to a face to face meeting and maladministrating complaints just for starters.

The Chair didn't answer our question. The CEO and Chief Ombudsman didn't either and nor did the Lead Ombudsman.

Q. Mr Javid, Business Secretary, doesn't the fact that RICS Members' and (Un)Regulated Firms' fees pay for the scheme and that their Director of Professional Regulation sits on the Board, not create a conflict of interest?

Dear Mr Javid,
The Ombudsmans61percent campaign is moving to: www.blogger.com: theombudsmans61percentcampaign because "BlogForever" is closing on 15th December 2015.

We first complained to the Chair of Ombudsman Services:Property, Prof. Dame Janet Finch on the 5th December 2010. A long 5 years ago.

We sent the Chair 100 questions. She handed them to the CEO and Chief Ombudsman, The Rev. Lewis Shand Smith who handed our complaint about the Lead Ombudsman back to the lead Ombudsman, Gillian Fleming. She said our questions had already been answered.

Only they hadn't.

Ombudsman Services is a black hole in our democracy.

Information goes into this private redress scheme but none comes out.

It has a Lead Ombudsman who routinely doesn't ask questions and who doesn't answer them either. And an ombudsman who doesn't ask or answer questions cannot conduct a meaningful investigation of a consumer's complaint.

Evidence for the huge levels of dissatisfaction this caused was once gathered by DJS Research via their Customer Satisfaction Reports. Those mismanaging the scheme put a stop to this. Now, no meaningful data on just how effective they are at resolving disputes "fairly" and "independently" is published.

There is no transparency or accountability.

However, we do know that the executives maladminister consumer complaints. The evidence for this maladministration came from the company's Independent Assessor. It was documented in her "First and Last Report - 2015."

We also know that the executives who maladminister this private redress scheme apparently aren't averse to throwing parties when they clear backlogs of consumers' complaints by the simple expedient  of cutting and pasting the lead Ombudsman's signature to reports written by investigating officers and sending them out to unsuspecting members of the public.

Mr Javid, that you knowingly allow this to happen surely holds our democracy in contempt.
